2. Purpose

These terms govern access to and use of the pokemar.es website, whose purpose is to provide information about the Poke Mar restaurant, its menu, its recipes and its booking and ordering channels.

3. Conditions of use

Access to the website is free of charge and requires no prior registration. Users undertake to use it in accordance with the law, these terms, good faith and public order, and not to use it for unlawful purposes or purposes harmful to third parties.

4. Intellectual and industrial property

All website content — texts, photographs, recipes, trade marks, logos, design and source code — belongs to Piazza Marbella, S.L. or to third parties who have authorised its use, and is protected by intellectual and industrial property law.

Reproduction, distribution, public communication or transformation is prohibited without express written authorisation, other than for personal, private use.

5. Reservations

Table reservations are handled through TheFork platform. Confirmation of the booking is governed by that platform's terms. Poke Mar reserves the right to release the table fifteen minutes after the booked time if the guest has not arrived.

6. Online orders

Delivery orders are placed entirely on the Uber Eats and Glovo platforms. Prices, delivery times, delivery charges and cancellation conditions are those set by each platform at the time of ordering and may differ from the prices applicable in the restaurant.

7. Menu prices and availability

Prices shown on the website include applicable VAT and are for information purposes. The menu may vary according to produce availability and season. In the event of any discrepancy, the price displayed in the restaurant shall prevail.

8. Allergens and food information

Allergen information is provided in accordance with Regulation (EU) No 1169/2011. Our dishes are prepared in a kitchen that handles all fourteen declarable allergens, so we cannot guarantee the complete absence of traces. If you have an allergy or intolerance, please tell our staff before ordering.

9. Third-party links

The website may include links to and embedded content from third parties (Google Maps, TheFork, Uber Eats, Glovo, Instagram). Poke Mar does not control those sites and is not responsible for their content or their privacy policies.

10. Liability

Poke Mar endeavours to keep the published information accurate and up to date but does not guarantee the absence of errors or uninterrupted availability of the site. It accepts no liability for damages arising from use of the website, except where imposed by law.

11. Changes to these terms

Poke Mar may amend these terms at any time. The applicable version is the one published on the website at the time of access.

12. Governing law and dispute resolution

These terms are governed by Spanish law. Any dispute shall be subject to the courts of the consumer's place of residence.
